Nationwide Coalition of Prosecutors Achieve Latest Settlement Against Generic Drug Makers

SACRAMENTO, Calif. (KEYT) – California joined a coalition of 48 states and territories in a $29.6 million settlement with generic drug maker Glenmark to resolve allegations of a years-long conspiracy to inflate prices, reduce competition, and restrain access to multiple generic drugs.

The latest settlement comes after previous settlements with other drug makers involved in the scheme, Lannett, Bausch, Apotex, and Heritage totaling $66.95 million shared the California Attorney General's Office.

The broad coalition of states and territories has been pursuing anti-trust cases against the drug makers since 2016, based on a series of investigations that relied on several cooperating witnesses, a 20 million document industry database, and interactions amongst over 600 sales and pricing people involved in the generic drug manufacturing sector detailed the California Attorney General's Office.

Part of this week's settlement agreement with Glenmark requires the drug company to cooperate with ongoing, multi-state litigations against 33 other corporate defendants and 25 individual executives as well as internal reforms intended to ensure compliance with the nation's antitrust laws noted the state's top prosecutor.

"Artificially inflating drug prices and blocking competition hurts consumers and the marketplace — full stop," Attorney General Bonta explained. "I'm pleased to resolve our claims against Glenmark with this settlement and stay focused on our ongoing litigation against others who have attempted to do the same."
