Restraining order filed against Ventura gym for continuing indoor operations during pandemic

VENTURA COUNTY, Calif. - The District Attorney of Ventura County, Gregory D. Totten, announced that the District Attorney’s Office Consumer and Environmental Protection Unit obtained a temporary restraining order against a gym in Ventura for continuing indoor operations during the pandemic.

BSF Fitness Center, located on Market Street in Ventura, has allegedly refused to comply with the state and county's health orders prohibiting indoor operations at gyms due to COVID-19 concerns.

The DA's Office said local officials requested BSF Fitness to comply with the health order multiple times, but the gym continued operating indoors anyway.

The DA's Office then filed a civil complaint against BSF alleging a violation of California’s Unfair Competition Law.

Despite these actions, the DA's Office decided Friday to file a restraining order against BSF Fitness which requires the gym to abide by the terms of the state and local health orders.

This temporary restraining order will be in place until the court determines whether a preliminary injunction, or court order, is necessary in order to enforce the health order at the gym while this case is pending.

An Order to Show Cause regarding the potential preliminary injunction is set for August 31 at 10 a.m. in courtroom 42 of the Ventura County Superior Court.
