2026 California Ballot: Proposition 5

Proposition 5: Require political seat vacancies following a recall to be filled by subsequent special election or appointment. Delaying the election of a successor until a separate election is done.

According to CalMatters:

  • Under the current law, voters decide in the same election whether or not to recall an officer, and who would replace an officer if recalled. If Proposition 5 is passed, the new measure would require a position or office to remain vacant until a subsequent special election is held to find a replacement.

FISCAL IMPACT: Net fiscal effect unknown. In the event of a recall, savings or costs of millions of dollars to administer the election depending on the office recalled.

"Yes" Vote:  Recall elections would no longer require voters to select a successor if an officer is recalled. A separate election would be require to fill a office vacancy.

"No" Vote: The recall election process would not change. Voters would continue to be asked who should fill the vacancy as part of recall elections.
