Santa Barbara Surgery Center lawsuit dismissed

UPDATE:

A lawsuit filed in November of 2017 against Santa Barbara Surgery Center has been dismissed.

Two former employees, both women in their 50’s, initially claimed wrongful termination, whistleblower retaliation and age discrimination.

Sterilization procedures and code violations were at the crux of the lawsuit.

Their attorney, Bruce Anticouni of Anticouni & Associates in Santa Barbara, revealed that his clients retracted all claims in full.

“The facts made clear that SBSC did not engage in unlawful or improper conduct. SBSC is an excellently run facility,” Anticouni stated.

Both plaintiffs apologized in a joint statement for “negative publicity” caused by their lawsuit.

“We appreciate that the individuals who filed the lawsuit have decided to retract their claims,” says A. Barry Cappello of Cappello & Noël LLP who represents SBSC.

Sterilization procedures and code violations are at the crux of the lawsuit. The complaint was filed in Santa Barbara County Superior Court Monday by Anticouni and Associates.

The plaintiffs are demanding a jury trial.

NewsChannel 3 reached out to Santa Barbara Surgery Center and a spokeswoman for the business said they look forward to clearing the allegations.
