Cal Poly Fraternity Member Arrested for Selling Pot

New details are emerging from the arrest of the president of a Cal Poly fraternity. 22-year old Gear McMillan is being charged with possession of marijuana and a controlled substance.

McMillan’s fraternity, Delta Sigma Phi, was the target of a violent armed robbery last month. Five Cal Poly football players have been charged in connection with the robbery.

Police investigated the activities of the fraternity house after the initial break-in. The investigation made it clear that drugs were being sold out of the house. Police say those football players were after those drugs and money and knew they could find them in the house.

Rob Gunness was busy Thursday hauling heavy furniture up a flight of stairs to help his daughter prepare for her sophomore year at Cal Poly. He didn’t expect to hear that his daughter’s next door neighbor, the Delta Sigma Phi fraternity house, was the scene of a drug arrest.

“It’s disappointing as a parent having a daughter up here,” said Gunness.

The fraternity house was quiet Thursday, after outgoing president Gear McMillan was hauled off to jail this morning on drug charges that include possession and intent to sell marijuana. A fraternity member at the house declined to answer questions about McMillan’s status with the fraternity.

Last month, 5 Cal Poly football players were arrested for breaking into the fraternity house and holding a fraternity brother at gunpoint.

After the arrests, police came up with a motive for the break-in.

“We’ve been following up with investigative leads as a result of that robbery with information that was provided to the police department that possibly the motive of that robbery was cash and drugs,” said Captain Keith Storton of the San Luis Obispo Police Department.

This morning police served a search warrant on Delta Sigma Phi and say they found McMillan with drugs.

Matt Lazier, a Cal Poly spokesman, says their is no disciplinary action being taken against the fraternity right now. Cal Poly responded to Thursday’s arrest with a statement:

There is no place for illegal activity at Cal Poly. We will take all necessary action to ensure student safety, wellbeing and success in the classroom and beyond. All student conduct violations will be met with appropriate disciplinary action. And we remain committed to cooperating with the San Luis Obispo Police Department and providing whatever support we can as they continue their investigation.

Police say more arrests could be coming as the investigation continues.

McMillan is booked in the county jail with bail set at $25,000. No word yet when he’s first scheduled to appear in court.
