Judge in Lindsay Clancy trial says he intends to declare mistrial, but gives defense 1 hour for appeal

After Judge William Sullivan said he intends to declare a mistrial in the case of Lindsay Clancy due to a hung jury on Friday, defense attorney Kevin Reddington asked for time to file an emergency appeal to the Supreme Judicial Court.

Sullivan gave Reddington an hour to file the appeal.

The jury’s note to the court again indicated they are deadlocked, this time using stronger language than the previous notes.

“It is with a heavy heart that we report we are unable to come to a unanimous decision and will not be able to,” the note read, according to Sullivan.

Clancy, 36, was charged with three counts of first-degree murder for the killings of her children: Cora, 5; Dawson, 3; and 8-month-old Callan. Jurors were also able to consider lesser charges of second-degree murder and manslaughter.

Clancy does not deny she strangled her children in the basement of their family home in January 2023. But her attorney argued she should not be held criminally responsible because she was suffering from postpartum psychosis at the time of the killings and her suicide attempt.
